Did an early bird special early spring. $650 house n roof. 200 deposit. wasnt even warm enough yet to do it. burnt the top of a bush. Not really bad but did. Never hapened before.
I told her to pay me what she thought the job was worth. She didnt send nothing.
Got 3 or 4 messages on vacation from her neighbor! She loved the work we did and wanted the same at same price. Gritting my teeth i drew up a contract.
She is already complaining about her deposit, she didnt want to give me one at first. She a lawyer bythe way.
Tonight I told her im just gonna refund your deposit, dont want anything to do with this now. Now she threatening court n chit?
Tell her you will refund her deposit as the season is getting too harsh to work, we can re-schedule in the spring. If she doesn't like that send her her money in a certified check sent by certified mail requiring a signature. If she cashes it you are good, if that doesn't work then tell her you refuse to work for some one that insists on using her legal position to force you to work. Let her know you will contact the bar association and file a complaint against her. Did you have a contract? what is in the contract if you do? if it is verbal, he said she said usually will get tossed in court provided you refund her the deposit. We never take deposits, once you do the customer feels like they own your azz, everytime.. Kim R

What do I do? what rights do I have?
This is a scare tactic for her as well as a control issue. I think you are right to send her a certified check as Kim suggests. There is nothing she can do to you as you haven't done anything for her yet. What will she gain by taking you to court? Any decent judge will read her the riot act for wasting the courts time. In all my years I have only walked off of one job. The husband and wife were both attorneys...
Mike, is the one complaining the person who loved the work? Why is she complaining about the deposit and is it illegal to hold her money until spring or something?

Phil he needs to give her the deposit back and renegotiate in the spring is she still wants the work done, But Mike does not want to work for her anymore. She is bullying him in to performance of the contract.... if there was one?? ( or technically sue to perform ) Kim R
Contracts are legally-binding promises made between two or more parties. When a contract is made, each party must give consideration, which means there must be an exchange of promises, or of actual goods or materials, at the time of contracting.
In order for a business to function as intended, and for transactions to be conducted properly, the law explicitly supports the rights set out in a contract. An exception to this rule is that if a contract is deemed unlawful, void against public policy, or drafted with serious inaccuracies akin to fraud, the rights reflected in that contract will not be legally guaranteed.
Outside of these exceptions, a party who does not do what he or she promised to do in a contract can be held liable for breach of contract and made to pay for the cost of any damages caused by the failure to perform.
